The problem arises if you are transiting to another flight on arrival--then you run into the "no liquids" rule in the EU if your origin is outside the EU. But if I fly from New York to Madrid, say, with a bag of tax-free booze, and Madrid is my final destination, then there will be no problem (except of course if the customs agents take an interest in the quantity I bring in, but that is a different issue).
