Subject: [Leica] Is this ethical?

The law here in the UK is that provided you are on public land then you may 
take photographs of any body and use them, provided that the use of the 
image in no way causes the subject any material damage. In the case of the 
two images you have shown, provided the land was public, I would have no 
problem using them.

Some confusion can arise over 2 points:

1. There is a difference between "public land" and land to which the public 
have access. To give you an example, you could photograph legally in the 
street outside a shopping mall but you could not photograph within that mall 
even though the public are free to enter and have full access.

2. There can be some argument over what damage an image may do, but in your 
case there is no material harm to the children.

That is my opinion, and I personally think this whole thing can be blown up 
out of all proportion.
