Not wanting to give legal advice, the Eleventh Amendment says that states
may not be sued unless they consent (which most do by legislation because
otherwise the electorate would be revolting (which some think they are
anyway)).  For years, states were able to avoid being sued for both patent
and copyright infringement, but a recent US Supreme Court case reversed
previous holdings as to copyright infringement and states now must comply
with the copyright laws in most instances.
