This rather reminds me of laws that prohibit procuring, even though prostitution
remains legal.  Sure, you can be a prostitute, but if you live off the money you
make that way, you can be prosecuted for pimping (even if you are pimping
yourself).

So, sure, you can photograph whatever you want, as long as you never do anything
with the photographs.  Not much of a consolation.
