It seems to me that even if the user is in the right, the real/eventual  
winner will be the one with the deeper pockets. Basically, make the user 
give up by making the cost of litigation too expensive. Easy to enforce new 
agreements even if the user does not get a fair or even legal position. Cost 
is negligible to.FB. 
For those thinking that the Internet is a socially responsible environment 
where monetization is nit THE corporate goal should grow up.
