The courts will not enforce "new" the same way as Leica. Neither
will users understand "new" the same way as the courts or Leica.
Nobody has a mortgage on the meaning of the word.

The word new does not mean unused. It is a loosely defined word.
My dictionary defines it as "lightly used".
