Robert -

The case was discussed on the PhotoNewsNetwork.  It is "Arrington vs. The 
New York Times"  and is a landmark case.  Mr. Arrington sued in court and 
won.  The case is still cited in model release disputes so it has not been 
appealed.

Don't forget that most juries would equate photographers with paparrazzi 
(or papaya as spell-check insists).
