The last time I looked into this area, the FAA defined commercial use of an 
aircraft as doing anything for hire that could not be accomplished without 
the use of an aircraft.  In other words, if aerial photography is for the 
purpose of making a profit, the pilot must be a rated Commercial Pilot.  I'm 
not sure whether or not such work would affect the licensing of the aircraft 
itself.  Better check the rules before starting such an endeavor.
