If I understand all this correctly, it's Magnum's fault, not the
photographer's. The material he provided was to give background that would
help a publication write its own story for which the photo's might serve as
illustrations. That text was never supposed actually to be the story or
appear as caption material or * most importantly * appear as an explanation
in a contest entry. POY had every reason to assume the material was a
sincere contest entry since it was, indeed, a contest. Magnum knew this and
should not have let this happen.
